Our total liability for any claims arising from or related to these terms or our services shall not exceed the amount you paid us in the twelve months preceding the claim, or €100 if no payments were made.

9.3 Third-Party Actions

9.4 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, or government actions.

10. Consequential Damages Exclusion

You acknowledge and agree that Form Studio shall not be held responsible for:

  • • Damage to reputation or brand value
  • • Cost of procurement of substitute services
  • • Loss of data not caused by our willful misconduct
  • • Any damages arising from delays in service delivery due to your actions or inactions

11. Force Majeure Provisions

Neither party shall be liable for any failure or delay in performing its obligations under these terms where such failure or delay results from any cause beyond the reasonable control of that party. Such causes include, but are not limited to: power failures, internet service provider failures, natural disasters, war, riot, labor disputes, acts of government, communications failures, or any other event beyond reasonable control. The affected party will notify the other party of such force majeure circumstances as soon as reasonably practicable.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without giving effect to any principles of conflicts of law. You agree that any legal action or proceeding between you and Form Studio shall be brought exclusively in the courts located in Cyprus, and you irrevocably submit to the personal jurisdiction of such courts.

If you are a consumer residing in the European Union, you may have additional rights under local law, and nothing in these terms affects your statutory rights as a consumer.

13. Dispute Resolution Procedures

In the event of any dispute, controversy, or claim arising out of or relating to these terms or our services:

13.1 Informal Resolution

We encourage you to first contact us directly to seek a resolution. Many disputes can be resolved quickly and satisfactorily through direct communication.

13.2 Mediation

If informal resolution is unsuccessful, both parties agree to attempt to resolve the dispute through mediation before pursuing litigation.

13.3 Litigation

If mediation fails, disputes will be resolved through the court system as specified in the governing law clause.

14. Severability Clause

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent. If modification is not possible, the provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect. The invalidity of any provision shall not affect the validity of the other provisions.

Our rights and remedies under these terms are cumulative and not exclusive of any rights or remedies provided by law.
